Article 1: Acceptance of the Conditions

1.1 Scope of the General Conditions of Use
These General Terms of Use govern access to and use of the Odeka platform, including but not limited to all web pages, interactive services, features, content and associated applications offered under the Odeka brand.

1.2 Acceptance of the Terms By accessing, browsing or using in any other way the Platform, each User, whether a visitor, Content Creator, Fan, or any other type of user, agrees to be bound without reservation by these T&Cs. If the User does not accept the T&Cs, he must refrain from using the Platform.

1.3 Modifications of the T&Cs Odeka reserves the right to modify, alter or update these T&Cs at any time. Continued use of the Platform after such modifications constitutes acceptance on the part of the User of the modified T&Cs.
 

Article 2: Definitions

2.1 Terminology

  • "Content Creator" means any registered user who creates, shares, uploads, or publishes content on the Platform.
  • "Fan" refers to any user who interacts with Content Creators' content, including but not limited to likes, comments, or shares.
  • "Content" refers to any material, text, images, video, audio, or other form of communication or creation shared on the Platform.

2.2 Interpretation The terms defined in these T&Cs will have the same meaning throughout the document, unless otherwise indicated or specific context which would require a different interpretation.

 

Article 3: Accounts and Registration

3.1 Account Creation
To access certain services or features of the Platform, including but not limited to Odeka Business or the referral program, Users must create an account by providing accurate, current and complete information.

3.2 User Responsibility
Each User is responsible for the security of their account, including maintaining the confidentiality of their username and password. The User is also responsible for all activities that take place under his account.

3.3 Updating Account Information
Users are responsible for maintaining and promptly updating their account information to ensure its accuracy. Odeka cannot be held responsible for the consequences arising from obsolete or incorrect information provided by the User.

 

Article 4: Responsibilities of Content Creators

4.1 Publishing Content
Content Creators undertake to only publish content for which they hold the necessary rights. They are fully responsible for all content they publish, including its accuracy, legality and compliance with intellectual property rights.

4.2 Prohibition of Illegal Content
It is strictly prohibited to publish illegal, offensive, defamatory content, or any other content that could harm the reputation of Odeka or that of other users.

4.3 Content Removal
Odeka reserves the right to remove any content that violates these T&Cs, applicable legislation or the rights of third parties, without notice and at its sole discretion.
 

Article 5: Fan Engagement

5.1 Respect for Copyright
Fans must respect the intellectual property rights of Content Creators and refrain from any unauthorized copying, distribution or use of the content.

5.2 Constructive Interactions
Fans are encouraged to interact positively and constructively with Content Creators, avoiding any abusive or disruptive behavior.

Article 6: Use of the Platform

6.1 Personal and Non-Commercial Use
The Platform is intended for personal and non-commercial use, unless otherwise agreed in writing by Odeka. Any unauthorized commercial use is strictly prohibited.

6.2 Conduct on the Platform
Users must behave responsibly and respectfully on the Platform, refraining from any illegal or harmful behavior.
 

Article 7: Intellectual Property

7.1 Content Rights
All content published on the Platform, including but not limited to artwork, text, graphics and videos, remains the property of their respective creators.

7.2 Use License
By publishing content on the Platform, Content Creators grant Odeka a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish and distribute this content.
 

Article 8: Limitation of Liability

8.1 Exclusion of Warranties
Odeka does not provide any guarantee as to the accuracy, reliability or completeness of the content available on the Platform, nor as to the availability or uninterrupted operation of the Platform.

8.2 Limitation of Liability
To the fullest extent permitted by applicable law, Odeka will not be liable for any direct, indirect, incidental, special, consequential or punitive damages arising out of the use of or inability to use the Platform.

Article 9: Modifications to the T&Cs

9.1 Right of Modification
Odeka reserves the right to modify these T&Cs at any time. The modifications come into force as soon as they are published on the Platform.

9.2 Acceptance of Changes
Continued use of the Platform after any modification constitutes acceptance by the User of the modified T&Cs.
 

Article 10: Applicable Law

10.1 Jurisdiction
These T&Cs are governed and interpreted in accordance with the laws of the country where Odeka is established. Any dispute relating to these T&Cs will be submitted to the competent courts of that country.
 

Article 11: Miscellaneous Provisions

11.1 Entire Agreement
These T&Cs constitute the entire agreement between Users and Odeka regarding the use of the Platform.

11.2 Indivisibility
If any provision of these T&Cs is found to be unenforceable, this will not affect the validity and applicability of the remaining provisions.
 

Article 12: Contact and Notification

12.1 Contact details For any questions relating to these T&Cs, the User can contact Odeka by the means made available on the Platform.

12.2 Notification Any notification regarding these T&Cs must be sent to the contact address specified by Odeka.

 

By using the Platform, the User acknowledges having read, understood and accepted to be bound by these T&Cs.
