    Article 1: Acceptance of conditions

    1.1 scope of general conditions of use These general conditions of use govern the access and use of the Odeka platform, including but without limiting themselves, all web pages, interactive services, functionalities, content and associated applications offered under the Odeka brand.

    1.2 acceptance of terms by accessing, sailing or using the platform, each user, whether it is a visitor, content creator, fan, or any other type of user, accepts to be linked without reservation by these CGU. If the user does not accept the T & Cs, he must refrain from using the platform.

    1.3 change in CGUs Odeka reserves the right to modify, alter or update these CGUs at any time. The continuation of the use of the platform after such modifications constitutes an acceptance on the part of the user of the modified CGUs.
     

    Article 2: Definitions

    2.1 terminology

    • "Content creator" designates any registered user who creates, shares, download, or publishes content on the platform.
    • "Fan" refers to any user who interacts with the content of content creators, including but without limiting themselves, by likes, comments, or shares.
    • "Contents" refers to any material, text, image, video, audio, or other form of communication or shared creation on the platform.

    2.2 interpretation The terms defined in these CGUs will have the same direction in the whole document, unless otherwise indicated or specific context which would require a different interpretation.

     

    Article 3: accounts and registration

    3.1 Creation of account To access certain services or features of the platform, including but without limiting themselves to Odeka Business or the sponsorship program, users must create an account by providing exact, current and complete information.

    3.2 user liability Each user is responsible for the security of his account, including the maintenance of the confidentiality of his identifier and his password. The user is also responsible for all the activities taking place under his account.

    3.3 Update of account information Users are required to maintain and update their account information quickly to ensure their accuracy. Odeka cannot be held responsible for the consequences arising from obsolete or incorrect information provided by the user.

     

    Article 4: Responsibilities of content creators

    4.1 Content publication Content creators undertake to publish only content of which they hold the necessary rights. They are fully responsible for all the content they publish, including their accuracy, legality and compliance with intellectual property rights.

    4.2 Prohibition of illegal content It is strictly forbidden to publish illegal, offensive, defamatory content, or any other content that could harm Odeka's reputation or that of other users.

    4.3 Content removal Odeka reserves the right to withdraw any content which violates these T & Cs, applicable legislation or third party rights, without notice and at its sole discretion.
     

    Article 5: Fans commitment

    5.1 Respect for copyright Fans must respect the intellectual property rights of content creators and refrain from any copy, distribution or unauthorized use of the content.

    5.2 Constructive interactions Fans are encouraged to interact positively and constructively with content creators, avoiding any abusive or disruptive behavior.

    Article 6: Use of the platform

    6.1 Personal and non-commercial use The platform is intended for personal and non-commercial use, unless otherwise written by Odeka. Any unauthorized commercial use is strictly prohibited.

    6.2 Driving on the platform Users must behave responsible and respectful on the platform, abstaining from any illegal or harmful behavior.
     

    Article 7: Intellectual property

    7.1 Rights on content All the content published on the platform, including but without limiting themselves, works of art, texts, graphics and videos, remains the property of their respective creators.

    7.2 use license By publishing content on the platform, content creators grant Odeka a non-exclusive, global and free rights license to use, reproduce, modify, adapt, publish and distribute this content.
     

    Article 8: Limitation of liability

    8.1 exclusion of guarantees Odeka does not provide any guarantee as to the accuracy, reliability or all of the content available on the platform, nor as to the availability or uninterrupted operation of the platform.

    8.2 Limitation of liability To the fullest extent permitted by the applicable law, Odeka will not be responsible for direct, indirect, accidental, special, consecutive or punitive damage resulting from the use or the inability to use the platform.

    Article 9: CGU modifications

    9.1 Modification right Odeka reserves the right to modify these Terms at any time. The changes come into force as soon as they are published on the platform.

    9.2 Acceptance of changes The continuous use of the platform after any modification constitutes the acceptance by the user of the modified CGUs.
     

    Article 10: Applicable law

    10.1 jurisdiction These CGUs are governed and interpreted in accordance with the laws of the country where Odeka is established. Any dispute relating to these CGUs will be submitted to the competent courts of this country.
     

    Article 11: Various provisions

    11.1 Integrality of the agreement These CGs constitute the entire agreement between users and Odeka concerning the use of the platform.

    11.2 indivisibility If a provision of these T & Cs is deemed inapplicable, this will not affect the validity and the applicability of the other provisions.
     

    Article 12: Contact and notification

    12.1 contact details For any questions relating to these CGUs, the user can contact Odeka by the means made available on the platform.

    12.2 Notification Any notification concerning these CGUs must be sent to the contact address specified by Odeka.

     

    Using the platform, the user acknowledges having read, understood and agreed to be bound by these CGU.
